[California, USA] Department of Toxic Substances Control (DTCS) & Triphenyl Phosphate

California’s Department of Toxic Substances Control (DTSC) has finalised a regulation to list nail products containing Triphenyl Phosphate (TPhP) at concentrations greater than 250 parts per million (ppm) as a Priority Product under the Safer Consumer Products Regulations.

The regulation, which seeks to reduce negative health effects for workers and consumers from exposure to TPhP, will take effect from 1 October 2026.

Although the regulation does not introduce an immediate ban on these products, manufacturers of affected products will have new regulatory responsibilities under the Safer Consumer Products framework.

DTSC states that manufacturers must submit a Priority Product Notification by 30 November 2026. Companies may also need to consider further regulatory steps, including whether to remove or replace TPhP, remove the product from the California market, or undertake an Alternatives Analysis.
